"Paternity" applies to verifying and establishing fatherhood. If the mother is married when the child is born, her husband is the legal father of the child. If the mother is not married, the child does not have a legal father. When a child is born outside of marriage, the father of the child does not automatically have the same rights and responsibilities as the father of a child born in marriage. Paternity legally declares who the father of a child is. If married when the child is born, it is assumed her husband is the father under the "presumption of legitimacy". If he is not the father, he can choose whether or not to claim paternity. Paternity fatherhood is established by: a) DNA Testing. Most states have laws that give Courts the power to order the suspected father to submit to DNA testing. He can be found in civil contempt for refusal to obey a court order DNA test. Or, b) If the mother is not married, the father can sign a " Voluntary Declaration of Paternity ". It is a voluntary form that both parents sign. When paternity is established, either parent can then ask for child support, custody, and visitation rights.

Paternity Lawyer can initiate the legal process of establishing fatherhood, filing a paternity suit, gathering DNA samples, and obtaining a court-ordered DNA test. Once paternity has been established the Paternity Lawyer can help establish a plan for collecting child support and inheritance rights if the father is deceased. The Paternity Lawyer can defend a client in paternity fraud when a man is falsely identified as the suspected biological father of a child because the mother withholds information that there may be more than one possible father. Paternity Mediation is used by lawyers and voluntary by unwed mothers and fathers to establish custody, visitation issues, insurance coverage, and special medical needs.

What is Paternity Law Arbitration ?

Paternity Arbitration is used when there are complicated legal issues, arbitration clauses, and choice of law as a procedural stage in the litigation of a case involving the conflict of laws when it is necessary to reconcile the differences between the laws of different legal jurisdictions. Arbitration provides a settlement conference where conflicting parties are able to express their opinion and augments and have a case settled without suing and going to court. Difference between Mediation and Arbitration is straightforward. Paternity Mediation is a voluntary process. Parties mutually agree upon a mediated settlement agreement. In most cases, Arbitration is a mandatory conflict resolution process stated in Arbitration Clause found in business contracts. Arbitrator hears opinions and facts from both disputants and issues an arbitration award which is a final verdict. Paternity Law Arbitration is quicker and cheaper than filing court lawsuit. Arbitration Clauses are found in most legal contracts and business agreements. Before seeking Arbitration, always try to settle dispute with voluntary mediation. The Arbitration Award is Final. Further legal process in law court is not permitted. In Mediation, if parties do not reach settlement, both arbitration and lawsuit litigation remain as legal options.
